This privacy policy is effective July 1, 2010.
RumbleWare Inc. (the “Company”) respects the privacy rights of our online visitors and is committed to protecting your personal information. To further this commitment, we have adopted this Online Privacy Policy (“Privacy Policy”) to govern how we collect, store and use the information you provide us.
Scope
This Privacy Policy currently applies to the following web sites operated by the Company:

In addition, the Company may own several other domain names that point to the web sites listed above. From time to time, we may add new web sites and will take reasonable steps to update the list.
Please note that this Privacy Policy applies only to information submitted and collected online through the web site listed above, and does not apply to information that may be collected by the Company offline. When you link to these web sites or to any other sites from a web site operated by the Company as listed above, the Privacy Policy for that website no longer applies.
Please note that by using our web sites, you signify your assent to the Company’s Online Privacy Policy. If you do not agree to this Privacy Policy, please do not use our site. We reserve the right to make changes to this Privacy Policy. If we make a material change to this Privacy Policy, we will notify you by changing the effective date above. Please check back from time to time to ensure that you are aware of these changes. Your continued use of our web sites will signify your acceptance of these changes.
Log Files
We review data and information contained in log files located on our web server, which record the date and time of each visit to our web site, the user's IP (internet protocol) address, the referring IP address or domain (the prior web site visited), and the files viewed on our web site (including HTML pages, graphics, etc.). We use log file information to analyze data in the aggregate to determine the trends and usage of our site. We do not correlate the log data to identify specific users.
We do not, and will not, disclose, sell, rent or share any information derived from log files with any third parties other than to Company’s affiliated companies (“Affiliates”), or as otherwise stated in this Privacy Policy.
Types of information Collected
In general, you can visit the Company web sites without telling us who you are and without giving any personal information about yourself. However, in order to give you the best experience on our web sites, the Company may collect information about you, but only if you voluntarily provide it to us. Typically, we may ask you to submit personal and/or demographic information for the following:
- Register on our website.
- Register to receive e-mail updates about a specific products or subscribe to a newsletter.
- Access and participate in our community forums.
- Participate in an online contest, sweepstakes or other promotion.
- Receive customer or technical support or give us feedback about a particular product.
- Fill out a poll, survey or questionnaire.
- Demo downloads and other program downloads.
Personal information collected in connection with these activities may include your first and/or last name, mailing address, telephone number and e-mail address. For some activities, we may ask you to create a username and password and to provide other personal information such as your age, date of birth, gender, occupation and other profile information (also known as “demographic information”). If demographic information is collected for an activity that also requires personal information, we may combine the demographic information with your personal information.
Use of Information Collected
Generally, information that we collect for a particular purpose is used for that purpose only. For example, if you sign up to receive information from us, the e-mail address that you provide will only be used to send you, via e-mail, such information. Similarly, information collected from those who register to use our forums (or message boards) is used to enable registrants to view and post messages on the boards. In some instances, however, you may also be given the option to have your information used for an activity or service different from the activity or service that you are requesting (e.g., to have your name entered into a contest when subscribing to a newsletter and vice versa). Only if you choose to receive these additional services, will the Company will use your information to provide these services to you.
We may use your e-mail address to send you service-related announcements that describe new areas or features on our web sites, changes to our online service or technical support policies and other related changes.
We may also use the personal and/or demographic information collected through one of the activities set forth above for our internal marketing and demographic studies, so we can constantly improve the online products and services we provide you and to better meet your needs.
No matter what method we use to collect information and no matter how we use that information, we will only collect the information deemed reasonably necessary to fulfill your online requests and our legitimate business objectives.
Please be advised that information submitted through our web site by individuals acting solely in a business capacity (e.g., a resumé from a job applicant) is not subject to this Privacy Policy. However, we want to assure you that information obtained from your resumé will be used solely for the purpose of accepting and evaluating your submission for a job opening.
Community Forums
Please note that whenever you give out personal information in public areas such as forums, that information can be collected and used by people you don’t know. While we strive to protect those who wish to participate in these forums, we cannot guarantee the security of any information that you post in these areas. If you wish to prevent others from seeing your e-mail address, please select to have your e-mail address hidden when registering for a forum.
Not Providing Personal Information
If you choose not to submit personal information when requested, you may not be able to participate in certain activities on our web site and may limit the services we can provide you. For example, if you refuse to provide your e-mail address to us, you will not be able to receive e-mail updates or participate in forums. To simply browse our web site, however, you do not need to give us any personal information.
Use of Cookies or Other Means of Collecting Information
We may use cookies to improve the use of our web sites. A “cookie” is a small file or record-keeping device that web sites often store on a user’s computer. Storage of cookies on your system provides an easy and convenient method for us to personalize your experience on our web sites. For example, cookies will remember your username and password, tell us that you have visited one of our web sites before and may contain other information that will make your next visit to one of our sites more enjoyable. We do not use cookies to collect personal information such as your name or to link your browsing habits to personal information already collected about you. You can always disable cookies or set your browser to alert you when cookies are being sent to your computer.
The Company may also keep track of Internet Protocol (IP) addresses for safety and security reasons (e.g., to ban forum access to abusers). An IP address is a number that is used by computers on the network to identify your computer every time you log on to the Internet.
The only other information passively collected by the Company is in the form of logs-files that record web site activity, including how many “hits” a particular web page is getting (a.k.a. “navigational data”). These entries are generated anonymously and enable the Company to assess overall web site activity, track interest in certain areas of the site, advertised sales and troubleshoot technical concerns. We also use the log file entries for our or our Affiliates’ internal marketing and demographic studies, so we can constantly improve the online services we provide you. Log files are used internally only, and are not associated with any particular user, computer or browser.
Links to Third Party Sites
You should be aware that while you are browsing one of our web sites, you may be directed to other sites that are beyond our control and for which we are not responsible. Because we cannot guarantee that the privacy policies of such sites meet our standards, we recommend that you read the privacy policy of the web site to which you link before you submit any personal information. We are not responsible for the collection, use, maintenance, sharing, or disclosure of data and information by such third parties.
Opting Out
If you do not want to receive our newsletter, e-mail updates, service related announcements or any other communications and/or services from the Company, please opt out of these communications or services at the time of registration or information collection. If you have opted in and, at a later time, wish to opt out, please contact us using the contact information provided below.
In addition, along with every newsletter sent to you, the Company provides the opportunity to discontinue receiving future newsletters (i.e., unsubscribe).
Safeguards
The Company maintains commercially reasonable safeguards that ensure the security, integrity and privacy of the personal information we collect. Personal information collected by the Company is stored in secure operating environments that are not available to the public and that are only accessible by authorized employees. We also have security measures in place to protect the loss, misuse and alteration of the information under our control (i.e., maintain data quality). Before we allow web users to access their personal information, for example, we verify their identity by requesting that they submit information such as their e-mail address or username and password.
Maintenance & Transmission of Data & Information
Although we use reasonable efforts to maintain the privacy of your personally identifiable data and information, due to technological limitations, and the risk of unlawful interceptions and accessing of transmissions and/or data, we cannot completely assure you, and you should not expect, that your personally identifiable data and information, and any other electronically communicated information, will be absolutely confidential.
For all e-commerce transactions, we use industry-standard commercial encryption technology to protect the data and information that you transmit to us via our web site. Although this technology is not flawless, we believe that it provides reasonable protection for your data and information. We will endeavor to update our protective devices as encryption technology develops further.
Once received, personally identifiable information is protected from outside the Company by "firewalls," and access within the Company is generally limited to the sales, marketing, and information technology departments.
Your Right to Review & Modify Data & Information
You have the right, at any time, to review and/or modify any of your personally identifiable information that you provide during registration, or any other voluntarily provided information. You may also remove yourself from our active databases of e-mail lists. To do so, you should send an e-mail to privacy@rumbleware.com requesting that (a) we provide a copy of your profile of personally identifiable information, (b) we update or modify certain personally identifiable information, or (c) you be removed from our databases of active e-mail lists. We will endeavor to comply with your request as soon as reasonably possible. To protect your confidentiality, we can only send a requested profile to the e-mail address listed in the profile. In any event, our back-up files will maintain copies of your personally identifiable information. We reserve the right to contact former customers or users of the web site from time to time.Required Disclosures of Data & Information
Regardless of anything in this Privacy Policy to the contrary, we may disclose personally identifiable information, with or without prior notice to you, when we believe that the law requires it, in response to subpoenas or at the demand of governmental agencies, to protect our systems or business, to protect other visitors to the web site, or to respond to an emergency. If you partake, or we reasonably suspect you of partaking in any illegal activity we may also disclose your personally identifiable information, even without a subpoena, warrant or court order. Correspondence
We maintain and review e-mail correspondence that you send to us. We will use (and maintain in a file specific to you) the personally identifiable information disclosed in the e-mail. Because such correspondence contains information that is not transmitted through the operation of our web site, it is not subject to the terms of this Privacy Policy.
Assignment
We reserve the right to transfer any and all information that we collect from our visitors to a third party in the event that we sell or transfer substantially all of our assets related to the web site to such third party.
